Terms of Service, Service Level Agreement (SLA), Data Processing Agreement (DPA), and Acceptable Use for Bench Energy and FreightTender.
Terms of Service
Use of Bench Energy websites, news, and FreightTender platform is subject to our general Terms of Service. By using our services you agree to these terms. Key points: you must use the service lawfully; you are responsible for your account and data; we may suspend or terminate access for breach.

Service Level Agreement (SLA)
- Uptime: 99.9% monthly uptime for FreightTender (excluding planned maintenance and force majeure).
- Support: Response times as per your plan (e.g. Standard <48h, Priority <24h, Enterprise 24/7).
- Credits: If we fail to meet the uptime SLA, we may provide service credits as set out in your agreement.
Data Processing Agreement (DPA)
For customers who need a formal DPA (e.g. under GDPR), we provide a Data Processing Agreement that specifies roles (controller/processor), processing instructions, sub-processors, security measures, and data return/deletion. Contact support@bench.energy to request a signed DPA.
Acceptable Use
You must not:
- Use the service for illegal purposes or in violation of applicable law
- Attempt to gain unauthorized access to systems or other users' data
- Transmit malware, spam, or abusive content
- Resell or sublicense the service without our written consent
- Use the service in a way that harms or overloads our infrastructure
We may suspend or terminate accounts that violate Acceptable Use.
